1. Acceptance of Terms

By accessing or using the Pulpi social media management platform (the "Service"), operated by Pulpi ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Pulpi. You represent that you are at least 16 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

Pulpi is a social media management platform that enables users to:

  • Connect and manage multiple social media accounts across platforms
  • Create, schedule, and publish content to connected accounts
  • Automate engagement activities (likes, comments, follows) within platform guidelines
  • Monitor analytics and performance metrics
  • Generate AI-assisted content and creative assets

The Service integrates with third-party social media platforms including Instagram, Facebook, X (Twitter), LinkedIn, TikTok, and YouTube via their official APIs.

3. User Accounts and Responsibilities

3.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.2 Social Media Accounts

You represent and warrant that:

  • You own or have proper authorization to connect and manage all social media accounts linked to the Service.
  • You will comply with the terms of service and community guidelines of each social media platform you connect.
  • You have obtained all necessary consents and permissions to publish content through the Service.

3.3 Accurate Information

You agree to provide accurate, current, and complete information when creating your account and to update such information as necessary.

4. Prohibited Uses

You agree not to use the Service to:

  • Send spam, unsolicited messages, or engage in any form of abusive bulk communication.
  • Harass, bully, threaten, or intimidate any individual or group.
  • Publish or distribute illegal, defamatory, obscene, or otherwise objectionable content.
  • Generate fake engagement, including purchasing followers, likes, or comments.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Violate any applicable law, regulation, or third-party rights, including intellectual property rights.
  • Attempt to gain unauthorized access to the Service, other user accounts, or connected systems.
  • Use the Service to circumvent rate limits, bans, or restrictions imposed by social media platforms.
  • Reverse engineer, decompile, or disassemble any part of the Service.

Violation of these prohibitions may result in immediate account termination without notice or refund.

5. Content Ownership and License

5.1 Your Content

You retain full ownership of all content you create, upload, or publish through the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit your content solely for the purpose of providing the Service.

5.2 AI-Generated Content

Content generated by the Service's AI features is provided to you for your use. You are solely responsible for reviewing, editing, and approving any AI-generated content before publication. We do not guarantee the accuracy, appropriateness, or originality of AI-generated content.

5.3 Our Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by Pulpi and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service as described herein.

6. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service is provided on a "best-effort" basis and may be subject to:

  • Scheduled maintenance windows
  • Unplanned outages due to technical issues
  • Third-party API changes, rate limits, or downtime
  • Force majeure events

No service level agreement (SLA) is provided for free-tier accounts. Paid plans may include specific uptime guarantees as described in the applicable plan documentation.

7. Payment and Billing

Certain features of the Service may require a paid subscription. If you subscribe to a paid plan:

  • Payments are processed securely through Stripe. We do not store your payment card details.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • Refunds are handled on a case-by-case basis. Contact us within 14 days of a charge for refund requests.
  • We reserve the right to modify pricing with 30 days’ notice to existing subscribers.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action.
  • Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.
  • We are not responsible for any actions taken by social media platforms in response to activities performed through the Service, including account suspensions, bans, or content removal.

9. Account Termination

9.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination, your data will be deleted in accordance with our Privacy Policy.

9.2 By Us

We reserve the right to suspend or terminate your account at any time, with or without notice, if:

  • You violate these Terms or any applicable law
  • Your use of the Service poses a security risk
  • Your account has been inactive for more than 12 months
  • We are required to do so by law or regulatory order

10. Indemnification

You agree to indemnify and hold harmless Pulpi, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your content, or your violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will provide additional notice via email or in-app notification.

Your continued use of the Service after any modification constitutes acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of France and applicable European Union regulations. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France.

For consumers residing in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
